If a member of the public, client, employer, or another professional believes a registered member of the AIA has demonstrated unprofessional conduct, they may submit a complaint to the Complaints Director. Complaints may also be made against former registered members if less than two years has transpired since the individual’s membership lapsed.
A registered member of AIA may be referred to the Complaints Director under section 44 of the Agrology Profession Act if information is obtained from the continuing competence program that indicates the member:
- displays a lack of competence in the provision of professional services that has not been remedied by participating in the continuing competence program, or
- the conduct of the regulated member constitutes unprofessional conduct that cannot by readily remedied by means of the continuing competence program.
Under section 49 of the Agrology Profession Act, the Complaints Director may act on information regarding unprofessional conduct even if a complaint has not been received.
Unprofessional conduct means any or all of the following:
- displaying a lack of knowledge of or a lack of skill or judgement in the provision of professional services;
- contravention of the Agrology Profession Act, the code of ethics or standards of practice;
- contravention of another enactment that applies to the profession;
- representing or holding out that a person was a regulated member and in good standing while the person's registration or practice permit was suspended or cancelled;
- representing or holding out that a person's registration or practice permit is not subject to conditions when it is, or misrepresenting the conditions;
- failure or refusal to comply with the requirements of a continuing competence program;
- failure or refusal
- to comply with an agreement that is part of a ratified settlement,- to comply with a request of or co-operate with an investigator, or
- to comply with a notice to attend or a notice to produce under Part 4;
- contravention of an order under Part 4 or conditions imposed on a practice permit;
- carrying on the practice of agrology with a person who is contravening an order under Part 4 or conditions imposed on a practice permit pursuant to Part 2 or 4; or
- conduct that harms the integrity of the agrology profession.
Should a member come under the scrutiny of the Complaints Director, an investigation and review of the member's practice may occur. The Agrology Profession Act section 48, provides the Complaints Director several options to investigate or resolve a complaint. Depending on the results of an investigation, the matter may be referred to the Hearings Director.
